Key differences between hoc arbitrations and institutional arbitration

Aspect of procedureAd hoc arbitration at BAC Institutional arbitration at BAC
Appointment of arbitratorParties have the complete liberty to  choose the arbitrator they want to appoint depending on the nature of the dispute and the underlying transaction.

On request BAC can also assist the parties in appointing arbitrators

The Clients / parties are subject to the rules and procedures of the Basavanagudi Arbitration Centre as they have agreed will conduct their arbitration in the Arbitration Agreement. Further as per the rules of the institutional arbitration the parties or clients can only appoint an arbitrator who is empanelled with that centre.
FeesParties can independently in consultation with their arbitrator decide the fees of the arbitrator.

The parties / clients will be required to only pay for the cost of the facilities they have availed in BAC. Costs of arbitration hall as well as other facilities are priced reasonably and provided to the clients upfront

On the other hand, institutional arbitration fee depends on the value and nature of the dispute. Further the Parties will have to pay the amount fixed by the centre upfront for all the payments for the dispute which covers the entire expenses of the arbitration.
Supervision of arbitration proceedingsThere will be minimal interference and supervision of the proceedings. The Parties in consultation with their arbitrator can agree on the procedure they would be utilising.Institutional arbitration rules offer a significant advantage by providing a structured, predictable framework that minimizes procedural delays and uncertainty. Unlike ad hoc arbitration, where parties must negotiate every rule from scratch, institutional rules come with a pre-established “rulebook” and a professional secretariat to oversee the process
